1. Acceptance of terms

By accessing or using nbafl.net (the "Site") or placing an order with North Bengal Agro Farms Ltd. ("NBAFL", "we", "us"), you agree to be bound by these Terms & Conditions and our Privacy Policy and Return & Refund Policy. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or legal guardian, to create an account or place an order. By doing so you represent that you have the legal capacity to enter into this agreement.

3. Account responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access.

4. Orders, pricing and availability

• Prices listed on the Site are in Bangladeshi Taka (BDT) unless otherwise stated and may change at any time without notice. The price applicable to your order is the price displayed at the time you place it.
• All orders are subject to acceptance and availability. We may refuse, limit or cancel an order at our discretion — for example if a listed item has become unavailable or there is a pricing error.
• Some products are sold by weight; actual delivered weight may vary by up to ±5% from the listed pack size and your invoice will reflect the actual packed weight.
• Our seasonal availability follows the harvest calendar published at /products; out-of-season items may not be available.

5. Payment

We accept Cash on Delivery and digital payments via bKash, Nagad and Rocket as listed at checkout. By submitting a payment you authorise us (or our payment partners) to charge the applicable amount. We do not store full card or banking credentials on our servers.

6. Delivery

Inside Dhaka delivery is charged at ৳70; outside Dhaka at ৳140, unless promoted otherwise. Delivery windows are estimates; we are not liable for delays caused by courier partners, weather, or other circumstances beyond our reasonable control. Risk of loss passes to you on delivery to the address you provided.

7. Returns and refunds

Quality issues, damaged or wrong items are handled per our Return & Refund Policy. Please read that policy for the report window (48 hours) and required evidence.

8. Acceptable use

You agree not to:

• Use the Site for any unlawful purpose or in any way that could damage, disable or impair the Site.
• Attempt to gain unauthorised access to our systems, accounts of other users, or any non-public area of the Site.
• Use automated systems (bots, scrapers) to extract data from the Site without our prior written permission, except for search-engine crawlers respecting robots.txt.
• Submit false, misleading or fraudulent information including in orders, contact forms or account registration.

9. Intellectual property

The Site's content — including the NBAFL brand, logos, product photography, text, layout and code — is owned by or licensed to North Bengal Agro Farms Ltd. and is protected by Bangladeshi and international copyright and trademark laws. You may not copy, reproduce, distribute or create derivative works without our prior written permission, except for normal browser-based viewing and the limited personal use of saving order confirmations.

10. User-submitted content

If you submit content to us (e.g. quality-claim photographs, contact-form messages), you grant us a non-exclusive, royalty-free, worldwide licence to use that content for customer-support, quality-improvement and operational purposes. You are responsible for ensuring you have the rights to submit any content you provide.

11. Disclaimers

The Site is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties — express or implied — including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Product images are representative; actual produce may vary naturally in size, shape and colour.

12. Limitation of liability

To the extent permitted by law, our total liability arising out of or relating to your use of the Site or any order placed through it is limited to the amount you paid us for the affected order. We are not liable for indirect, incidental, consequential or punitive damages.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by our negligence, fraud, or wilful misconduct.

13. Indemnity

You agree to indemnify and hold NBAFL harmless from claims arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party rights.

14. Termination

We may suspend or terminate your access to the Site or your account at any time, with or without notice, for breach of these Terms or for any other reason at our discretion. Termination does not affect rights or obligations that survive — including outstanding payment obligations, indemnities and limitations of liability.

15. Governing law and disputes

These Terms are governed by the laws of the People's Republic of Bangladesh. Any dispute arising out of or relating to the Site or these Terms will be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh, except where prohibited by applicable consumer-protection law.

16. Changes to these terms

We may update these Terms from time to time. The "Last updated" date above will change. Material changes will be communicated by email to registered account holders and via a notice on the home page for at least 30 days. Continued use of the Site after the effective date of changes constitutes acceptance of the updated Terms.

17. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect.
